CANCELLATIONS
Scootours Cape Town PTY (Ltd) is a business in the tourism industry that provides adventure activities .
There will be no refunds in the event of a no-show by guest on the activity date if the booking is prepaid.
In the event of an amendment not received 3 days prior to activity booked the guest will still be responsible for the full cost for the total number of passengers originally confirmed.
Management reserves the right to cancel any activity due to unforeseen circumstances including but not limited to, insufficient passengers and/or unfavourable weather conditions.
In case of a weather cancellation, weather conditions are judged exclusively by the Management of Scootours Cape Town, guests must report for the service/activity unless notified by Scootours Cape Town Management.
In the event of a cancellation by Scootours Cape Town Management, a full refund will be given on the amount paid (or refunded to booking agent).
DELIVERY POLICY
Subject to availability and receipt of payment, requests will be processed within 2 days and delivery confirmed by way email.
INDEMNITY
All participants are required to sign an indemnity form for all activities they are participating in prior to departure of the activity.
If a guest refuses to sign the indemnity form, the guest will not be able to partake in the activity.
The indemnity form must be signed by a Parent/Legal guardian for minors under 16 years.
Any unaccompanied child 16 or under requires the indemnity to be signed by a parent/legal guardian prior to the activity.
CHILD POLICY:
Children Rates apply to minors aged between 4 and 9 years who join trip as a passenger on a Scooter. For minors 10 years and older adult rates apply.
Minimum age is 4 years and minimum hight is 95cm
Children between 4 and 9 years are passengers with parents and Scootours Passenger Tickets prices apply.
Children from the age of 10 years and up can ride their own scooter and Scootours Driver Tickets Prices apply.
Adult supervision are required for kids of 12 years and younger.
GENERAL
2 guests required to run a trip.
Management reserves the right to amend/cancel/add terms & conditions without notice.
All terms & conditions are subject to South African Law & Jurisdiction.
REFUND POLICY
The provision services by Scootours Cape Town is subject to availability. In cases of unavailability, Scootours Cape Town will refund the client in full within 30 days.
CANCELLATION POLICY
30 days cancellation before arrival 100% refund
29 - 15 days cancellation before arrival 75% refund
14 – 4 days cancellation before arrival 50% refund
3 days-24 hrs cancellation before arrival 0% refund
If trips are cancelled by Scootours Cape Town due to bad weather then Scootours Cape Town will refund the client in full within 30 days.

PAYMENT OPTIONS ACCEPTED
Online Payment may be made via Visa and MasterCard.
Payment can also be made via Electronic Transfer or Cash on arrival.
CARD ACQUIRING AND SECURITY
Card transactions will be acquired for (Your Company) via PayGate (Pty) Ltd who are the approved payment gateway for all South African
Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the
website. Users may go to www.paygate.co.za to view their security certificate and security policy.
CUSTOMER DETAILS SEPARATE FROM CARD DETAILS
Customer details will be stored by (Your Company) separately from card details which are entered by the client on PayGate’s secure site. For

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is
South African Rand (ZAR).
COUNTRY OF DOMICILE
This website is governed by the laws of South Africa and Scootours Cape Town chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
VARIATION
Scootours Cape Town may, in its sole discretion, change this agreement or any part thereof at any time without notice.

THIS IS A LEGALLY VALID AND BINDING OBLIGATION TO RELEASE Scootours Cape Town t/a Vinebikes FROM ALL KNOWN AND UNKNOWN OBLIGATIONS, AND TO INDEMNIFY Scootours Cape Town t/a Vinebikes AGAINST CLAIMS BROUGHT AGAINST IT BASED UPON YOUR USE OF THE BICYCLE. THIS INSTRUMENT AFFECTS IMPORTANT LEGAL RIGHTS.
Release and Waiver of Claims For valuable consideration, the receipt and sufficiency of which are hereby acknowledged Renter does hereby remise, release, and forever discharge Scootours Cape Town t/a Vinebikes, Scootours Cape Town t/a Vinebikes’S agents, servants, successors, heirs, executors, administrators and personal representatives, of and from all, and all manner of, actions, causes of action, suits, proceedings, debts, dues, contracts, judgments, damages, claims, and demands whatsoever in law or equity, which Renter ever had, now has, or which Renter’s heirs, executors, administrators or personal representatives hereafter can, shall, or may have for or by reason of any matter, cause, or thing whatsoever arising out of this Agreement; out of the use (misuse, or abuse) of the bicycle; or in any way arising out of the rental relationship between Renter and Scootours Cape Town t/a Vinebikes. Bicycle Rental Agreement and Release Indemnification For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Renter hereby expressly agrees to indemnify and hold harmless Scootours Cape Town t/a Vinebikes, Scootours Cape Town t/a Vinebikes’S agents, servants, successors, heirs, executors, administrators and personal representatives against all suits, actions, claims, demands, or damages that arise out of Renter’s use, misuse or abuse of the bicycle. Terms and Conditions 1. Assumption of Risk. Renter acknowledges that the activities for which the bicycle is designed include inherent dangers, including the risk of bodily injury and/or death. Renter assumes and accepts all risks associated with the use of the bicycle. RENTER INITIALS 2. Acceptable Use. Renter agrees and acknowledges that he/she will be the sole operator of the bicycle, and will use the bicycle in a careful, safe and conscientious manner. Renter shall at all times observe and adhere to any rules and guidelines posted by Scootours Cape Town t/a Vinebikes, and any applicable laws or regulations. 3. Prohibited Activities. Renter shall not violate any of the following rules and regulations during his/her operation of the bicycle: • There are no passengers permitted on the bicycle unless expressly permitted by Scootours Cape Town t/a Vinebikes in writing prior to use. • There is no smoking while on the bicycle. • There are no alcoholic beverages permitted while using the bicycle. 4. Unsafe Use. If at any time Scootours Cape Town t/a Vinebikes determines that Renter has engaged in an unsafe or hazardous use of the bicycle, Scootours Cape Town t/a Vinebikes may immediately terminate the rental. Upon notification of termination, Renter must return the bicycle to the designated return area immediately. If the rental is terminated for unsafe or hazardous use, Renter will not be refunded his/her security deposit. Scootours Cape Town t/a Vinebikes shall determine, in its sole discretion, whether any behavior or activity is “unsafe or hazardous.” 5. Condition of Bicycle upon Return. The Renter shall return the bicycle to the designated return area clean and in the same condition as it was in when given to Renter, excepting ordinary wear and tear. Renter shall be responsible for any damage caused to the bicycle during the rental period. Scootours Cape Town t/a Vinebikes shall retain any portion (or all) of Renter’s security deposit as necessary to cover repairs for such damages. To the extent that damages to the bicycle exceed the amount of the security deposit, Renter shall be billed by Scootours Cape Town t/a Vinebikes for the full amount of damages caused by Renter during the rental period, including reasonable attorney’s fees. 6. Late Return. If Renter returns the bicycle to the designated return area more than 1 hour after the scheduled “Time Back,” Renter shall forfeit his/her security deposit. Renter has read and understands all of the terms, conditions and rules set forth above, and agrees to all terms without reservation.
